RULES OF THE GAME WITH OBLIGATION TO PURCHASE  
"HORIZON PROJECT" 

New Article 1.1 – Changing Game Duration 

The organizing company immediately modifies the duration of the game which was initially scheduled from 19/02/2023 to 16/06/2023 which will therefore end on 24/04/2023. 

The amendment takes effect upon publication. 

The organizing company modifies articles 2 and 4 of the said regulations accordingly. 

Article 1 - Organizing company 

Klingler Brothers, a limited liability company with capital of €5, registered in the Trade and Companies Register of Bourg-En-Bresse under number B 000,00 884 938, having its registered office at 671 rue de la cime in Leyment, France, represented by its current Manager residing in said capacity, (hereinafter referred to as "the Organizer"), is organizing a game with an obligation to purchase entitled "Horizon Project" (hereinafter referred to as "the Game "). 

The terms of participation and designation of winners are described in these rules (hereinafter referred to as "the Rules"). 

These rules define the legal rules applicable to this game. 

Article 2 – Duration of the game: Modification 

The Game will take place from February 19, 2023 to April 24, 2023  

If all the products offered for sale, 3500 TEE-SHIRTS/sticker packs, are sold before this date, the game will end.

Article 3 - Price 

The winner will take home a used and prepared Royal Enfield Interceptor 650 displaying 3000 km, worth €18 and a custom made GUANG helmet. 

The costs related to the recovery of the prize will be borne by the winner and will be recovered from the organizer. The prize awarded cannot be contested by the winner. 

In the event of force majeure or if the circumstances so require, the organizing company reserves the right to replace the prizes won with prizes of equivalent or greater value. 

Article 4 – Terms of participation: Modification

Fill in the required fields NAME/ FIRST NAME/ ADDRESS/ TELEPHONE/ EMAIL 

Applications will be validated and entered into the draw only for Participants who correctly follow the steps. Participants must be informed: 

  • That any cancellation or refund request will void participation in the Game; 
  • In the event of an unresolved PayPal dispute in favor of Klingler Brothers or in the event of non-payment in full of the t-shirt/sticker pack, participation in the Game will be canceled and the t-shirt/sticker pack will once again become the property of Klingler Brothers. 

Article 5 – Designation of the winner 

The winner will be drawn there by the organizing company, under the control of Maître Marlène ENJALBERT – Bailiff, residing there, 13 Rue de la République, 01500 Ambérieu en-Bugey. 

The draw will be carried out within thirty days, following the close of the Game, from among all complete entries (as described in Article 2).  

There will be one winner per household. The name of the Participant drawn at random will designate the winner of the Game (hereinafter "The winner").  

Two substitutes will also be drawn at random, in the event that the winner does not contact the organizing company.

Article 6 - Attendees 

Participation in the Game is exclusively online, excluding any other means, including by post. Participation implies unreserved acceptance of these rules, the ethical rules in force on the Internet (etiquette, charter of good conduct, etc.) and the laws and regulations applicable to competitions in France. 

The game is open to any natural person of full age (at least 18 years old) residing in metropolitan France (including Corsica), having fixed internet access and a personal email address at which they can be contacted for the needs of the Game (hereinafter "the Participant"). 

Article 7 - Limits to participation  

The game is not open to staff of the organizing company or any company that has participated in or has been associated with it. 

Any application for participation or participation made in fraud of these provisions entails the rejection or retroactive cancellation of registration. 

Article 8 – Information of the winner and delivery of prizes 

The winner will be informed directly by the company organizing the game by telephone, post or email of their win within ten (10) days of the draw. 

It is reminded that a participant is identified by the coordinates that he will have himself provided during his registration. In the event of a dispute, only the listings of participants provided by the organizing company will be taken into account. 

The prize, not claimed by the winner within two weeks (14 days) will be considered lost and will be awarded to the first substitute drawn at random. 

The winner authorizes the organizing company to publish his name on the internet or on any other medium it deems useful. The name of the winner will be displayed on the site after the draw. 

The winner accepts that the award ceremony will be filmed and broadcast on social networks, internet, television and any other communication medium. 

The organizing company disclaims all liability in the event that a participant who has purchased a product concerned by the game on the site has not received the product in time to be able to return, within the aforementioned deadlines, the necessary supporting documents. In general, the organizing company disclaims all responsibility for the compatibility of deadlines in the event of purchases on the internet. No exceptions will be allowed. 

Any incomplete or inaccurate contact details will be considered void and will prevent the winner designated by random draw from obtaining their prize. In general, entries into the Game will be 

canceled if they are incomplete, erroneous, counterfeit or carried out in a manner contrary to these rules. 

Article 9 - Modification of the game and the rules 

The organizing company reserves the right to postpone, extend or shorten the game, as well as to modify all the conditions of access and/or the terms of execution, without having to justify it and without incurring its liability.  

All rule changes will be announced on the game page and will be effective upon posting. 

Entrants will be deemed to have accepted such changes by continuing to participate in the Game from the date of the change. 

Article 10 - Privacy - Data processing and freedoms 

The personal information collected in the entry form is required. They are intended solely for the Organizer of the company and only to take into account the participation in the game, to manage the winner, to award the prizes and to comply with legal and regulatory obligations. They may be transmitted to service providers and subcontractors to whom the Company Organizer may call for the needs of the organization and/or management of the game. 

In accordance with the modified law n° 78-17 of January 6, 1978 relating to data processing, files and freedoms, all Participants have the right to access, rectify, delete and oppose information concerning them on simple written request sent to the Game Address. Exercising the right to delete information concerning a Participant will result in the cancellation of his participation in the game. 

Article 11 - Filing of game rules  

The rules are deposited in the study of Maitre Marlène ENJALBERT - Bailiff, residing there, 13 rue de la République, 01500 Ambérieu-en-Bugey.

Article 12 - Communication of the rules 

These Rules can be consulted throughout the duration of the Game on the site page  https://frenchmotoshop.com/pages/concours-royal-enfield-horizon 

It can be sent free of charge to anyone who requests it. 

The request will be addressed to, the company Klingler Brothers, 85 rue de la cime in Leyment, France 

Reimbursement of application costs will be made on the basis of a simple letter weighing less than 20 grams franked at the economy rate if a letter has been sent. 

Article 13 - Reimbursement of participation fees 

Participants who meet the conditions of access and participation in the game can obtain a refund of participation fees by making a written request to the address of the game before June 16, 2023 at midnight or at the latest 10 calendar days after the date of the invoice from the internet service provider if they receive it after the deadline. 

The reimbursement request must include the following information in a legible manner: • surname, first name and full address of the participant; 

  • game name and site URL; 
  • connection dates and times; 
  • detailed copy of the service provider's invoice with the connection dates and times clearly underlined; 
  • RIB or RIP for metropolitan France in the name of the participant. 

Only one request per household (same name, same address). The organizing company only reimburses participants who have accessed the site https://www.frenchmotoshop.com/ from a fixed Internet connection and which respect the conditions of access and participation in the game. 

Applications that are incomplete, illegible or sent to an address other than the game address or after the deadline will be considered void. 

Article 14 - Responsibilities 

The liability of the Organizing Company is strictly limited to the delivery of prizes validly won. It is recalled that the Internet is not secure, the Organizing Company cannot therefore be held responsible for contamination by potential viruses or the intrusion of a third party into the system of the participant's terminal. They decline all responsibility for the consequences of the connection of participants to the network via the site. https://www.frenchmotoshop.com/. En 

In particular, the Organizing Company cannot be held responsible for any damage caused to participants, their computer equipment and stored data, as well as the consequences on their personal or professional activity. 

The Organizing Company will not be liable in the event of malfunction of the Internet network, telephone lines or reception equipment which prevents the smooth running of the game. 

The Organizing Company will also not be liable if one or more participants cannot connect to the website https://www.frenchmotoshop.com/ or play because of any technical problem related to, for example, network congestion. The Organizing Company may cancel all or part of the game if fraudsters intervene in any form whatsoever, in particular by computer means within the framework of participation in the game or the determination of the winner. In this case, it reserves the right not to award the prizes to the fraudsters and/or to sue the perpetrators of these frauds before the competent courts. 

The Organizing Company will do its utmost to allow access to the game on the site  https://www.frenchmotoshop.com/ at any time, without being bound by any obligation to do so. The Organizing Company may at any time, in particular for technical or updating reasons, interrupt access to the site https://www.frenchmotoshop.com/ and the game they contain. The Organizing Company will in no way be responsible for these interruptions and their consequences. 

The Organizing Company cannot be held responsible for any incident or accident that may occur during the enjoyment of the prizes awarded and/or their incorrect use by the winner. 

Article 15 - Disputes - Applicable law - Disputes  

Participation in the game implies full and unreserved acceptance of these rules by the players.  

In the event of a dispute or claim, for any reason whatsoever, requests must be sent in writing to the Organiser, Klingler Brothers, 85 rue de la cime à Leyment, France, within two months of the end of the competition (depending on postage stamp). 

This game is subject to French law so that participants are subject to French regulations applicable to games and contests. 

In the event of persistent disagreement on the application or interpretation of these rules, and in the absence of an amicable agreement, any dispute will be submitted to the court having the right, to which exclusive jurisdiction is attributed.
